China famous actress Fan Bingbing disappeared for 120 days after she was exposed to a tax-related issue in early June. She recently returned to the public eye with an apology on her Weibo. According to Xinhua, the JSSAT of China has asked Fan Bingbing to pay a sum of more than RMB 880 million and punished the units and personnel responsible for the case according to law.

Fan Bingbing actually earned RMB 30 million in the movie "Big Bomb," of which 10 million had declared tax, but the remaining 20 million had evaded 6.18 million personal income tax by breaking up contracts, underpaid business tax and added RMB 1.12 million, totaling RMB 7.3 million. In addition, Fan Bingbing and his legal representative underpaid RMB 248 million, including RMB 134 million for tax evasion.

 

In accordance with the Regulations of the Tax Administration Law of the People's Republic of China and the Detailed Rules for the Implementation of the Tax Administration Law of the People's Republic of China, the Jiangsu Tax Bureau required Fan Bingbing and his enterprises as legal persons to recover taxes, late fees and fines exceeding RMB 880 million.

 

The Fan Bingbing case has already come to light, but the things she did is far from over. China State Administration of Taxation has deployed the work of standardizing the tax order of the film and television industry and has charged the Jiangsu Provincial Taxation Bureau with accountability in accordance with the law for the relevant personnel of the former Wuxi Local Taxation Bureau and its sixth sub-bureau.

 

The Wuxi Tax Bureau of the State Administration of Taxation has made a thorough review and carried out practical rectification measures, giving administrative warning to Ding Yuan, chief accountant Li Qing, deputy director of Hubin District Taxation Bureau Zhong Xiaoxin and deputy director of Liangxi District Taxation Bureau Shen Zhiguo, and other relevant responsibilities, Xinhua reported Wednesday. People were punished accordingly.

Fan Bingbing was legally recovered from the tax and late payment by the tax bureau. However, why Fan Bingbing did not have to be jailed caused public discussion. Although Liu Xiaoqing was not eventually prosecuted, he was detained for 422 days in a criminal detention facility, living with ordinary criminal defendants and criminals. She confessed that the worst thing she feared in the shelter was being shot, and when she got out of prison she thought it was nothing but death.

 

Liu Xiaoqing's criminal law was formulated in 1997, so long as the act constitutes tax evasion, he will be imprisoned. However, in 2009, the crime of tax evasion was renamed as the crime of tax evasion because, given the growing income of the people, stringent law enforcement would be increasingly stringent and would have an impact on the normal operation of enterprises during the investigation period.

 

Moreover, if convicted, it can lead to bankruptcy, imprisonment of the boss, and resettlement of workers, which is not conducive to the state and society. Therefore, according to Article 201 of the Criminal Law of the People's Republic of China, a large amount of tax evasion can be sentenced to fixed-term imprisonment of not less than three years but not more than seven years and a fine.

 

However, the Regulation also states that those who have been subjected to administrative punishment after the tax authorities have issued a notice of recovery according to law, paid the tax payable and late payment, will not be investigated for criminal responsibility, and those who are not first offenders will not be exempted. Fan Bingbing was first given administrative punishment by the tax authorities for tax evasion and had not been punished for evading paying taxes before, so he could be exempted from prison by paying within the prescribed time limit.
